TERMS OF SERVICE

This website is operated by Mount Moon TCG, an Australian sole-trader business based in Perth, Western Australia.

By accessing this website, placing an order or purchasing from Mount Moon TCG, you agree to these Terms of Service and the policies linked on this website.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under the Australian Consumer Law.

PRODUCTS AND AUTHENTICITY

Mount Moon TCG is an independent retailer of genuine trading card products.

Product descriptions, language, condition, quantities and photographs form part of each listing. We take reasonable care to ensure product information is accurate. Legitimate packaging, printing and other minor details may vary between manufacturer print runs.

Trading card products contain randomly inserted cards. Unless expressly stated in a listing, Mount Moon TCG does not guarantee:

  • Any particular card or rarity
  • Pull rates or product contents beyond those specified by the manufacturer
  • A particular grading result
  • Future availability or market value
  • Any financial or investment return

PRICING AND PAYMENT

All prices are displayed in Australian dollars unless stated otherwise. Applicable taxes are included where required.

Shipping costs, discounts and the final order total are displayed during checkout before payment is completed.

We may correct genuine pricing, description or listing errors. If an error affects an order, we may contact the customer to confirm the corrected order or cancel the affected item and issue the applicable refund.

ORDERS AND ACCEPTANCE

Submitting an order does not guarantee acceptance or availability.

An order is accepted when it is confirmed for fulfilment. We may cancel or limit an order for a reasonable cause, including:

  • Unavailable or incorrectly recorded stock
  • Payment failure
  • A genuine pricing or listing error
  • Suspected fraud or unauthorised payment
  • Suspected commercial resale or misuse of a promotion
  • Delivery restrictions
  • Another significant operational issue

If we cancel a paid order, the applicable amount will be returned to the original payment method.

CUSTOMER INFORMATION

Customers must provide complete and accurate contact, billing and delivery information.

Contact us promptly if an order needs to be changed or cancelled. Changes and cancellations cannot be guaranteed after processing or dispatch has begun.

SHIPPING

Shipping arrangements, costs, processing times and tracking information are described in our Shipping Policy.

Delivery timeframes are estimates unless expressly guaranteed. Mount Moon TCG is not responsible for carrier delays outside our reasonable control, but we will provide reasonable assistance with genuine delivery issues.

RETURNS AND CONSUMER GUARANTEES

Change-of-mind return conditions are described in our Refund and Returns Policy.

Products sold by Mount Moon TCG come with consumer guarantees that cannot be excluded under the Australian Consumer Law. Where a product fails to meet an applicable consumer guarantee, the customer may be entitled to a repair, replacement, refund or another remedy required by law.

PRE-ORDERS

Where a product is clearly identified as a pre-order:

  • The expected release or dispatch date is an estimate unless expressly guaranteed
  • Release dates may change due to manufacturers, suppliers, carriers or other circumstances outside our control
  • Products purchased in the same order may be held until the pre-order item is available unless otherwise stated
  • Any pre-order cancellation terms displayed on the product page form part of the purchase terms

Nothing in this section limits rights available under the Australian Consumer Law.

PRODUCT CONDITION

Single cards and graded cards are sold in the condition described in their listings. Product photographs form part of the description where the listing identifies the pictured item as the exact product.

Customers should review the condition description and photographs before purchasing.

WEBSITE USE

You must not:

  • Use the website for unlawful, fraudulent or abusive purposes
  • Interfere with the website’s security or operation
  • Attempt unauthorised access to accounts, systems or information
  • Submit false or fraudulent orders
  • Scrape, copy or reproduce store content in a way that infringes our rights or the rights of others
  • Use automated systems to disrupt purchasing or obtain an unfair advantage during limited releases

We may restrict access or cancel affected orders where reasonably necessary to protect customers, the store or other users.

INTELLECTUAL PROPERTY

Mount Moon TCG branding, original product photographs and original written content remain the property of Mount Moon TCG unless otherwise stated.

Third-party product names, characters, artwork, images, logos and trademarks remain the property of their respective owners and are used to identify and describe genuine products offered for sale.

Mount Moon TCG is not affiliated with, endorsed by, sponsored by or associated with The Pokémon Company, Nintendo, Creatures Inc. or GAME FREAK inc.

THIRD-PARTY SERVICES AND LINKS

The website may use or link to third-party services, including Shopify, payment providers, delivery carriers and social platforms. Those services may be governed by separate terms and privacy policies.

LIABILITY

To the extent permitted by law, Mount Moon TCG is not responsible for:

  • Indirect or consequential loss that was not reasonably foreseeable
  • Changes in collectible market value
  • Customer dissatisfaction with random card contents or pull rates
  • Delays or service interruptions outside our reasonable control
  • Loss caused by inaccurate information supplied by the customer

This section does not limit any liability, consumer guarantee or remedy that cannot legally be limited.

CHANGES TO THESE TERMS

We may update these terms when our business practices, services or legal obligations change. The terms published on the website at the time an order is placed apply to that order unless otherwise required by law.

GOVERNING LAW

These terms are governed by the laws of Western Australia and applicable laws of Australia.
